Description: We represented the executor of a decedent's estate in a suit alleging that the decedent's nephew converted the proceeds of numerous savings bonds titled to the decedent. The bond proceeds were deposited to a once-joint bank account the nephew held with his aunt after she died. Although the nephew had no ownership or other interest in the bonds, he retained the bond proceeds and refused to return them to his aunt's estate. After a bench trial, the court awarded judgment to our client in the principal amount of $158,314.40, plus prejudgment interest at the statutory 6% rate.
The nephew appealed the trial court's decision to the Supreme Court of Virginia. After the Court refused to hear the merits of his appeal, the nephew paid the judgment and interest owed, which totaled $217,219.06.
