In this case, our client was driving down Monument Avenue in Henrico County, when a vehicle operated by another driver ran a stop sign, continued through the median, and struck the driver's side door of our client's vehicle at a high rate of speed. The driver who struck our client was an individual who was not working for any employer at the time of the crash. As a result of the crash, our client suffered a mild traumatic brain injury, rib fractures, and orthopedic/soft tissue injuries. His post-concussion symptoms were signficant and had a major impact on his life, especially during the months immediately following the crash. However, the case was not without its complicating factors, including our client's complicated past medical history.
We filed suit against the defendant in the Circuit Court of the City of Richmond, where she lived. Fortunately, unlike many individual defendants, she maintained an insurance policy with coverage limits well in excess of Virginia's statutory minimum. The case ultimately settled during a mediation conducted about six weeks before trial.
